    1. Introduction and Acceptance

    Welcome to CheckInn Africa ("CheckInn," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the CheckInn website located at checkinn.africa (the "Platform"), including any services, features, content, and applications offered through the Platform.

    CheckInn is operated by InnSync Technologies, a company registered in the Republic of Ghana.

    By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.


    2. Definitions

    • "Guest" or "you" refers to any individual who accesses the Platform to search for, view, or book accommodations.
    • "Hotel" or "Property" refers to any hotel, guesthouse, or accommodation provider listed on the Platform.
    • "Booking" refers to a reservation made through the Platform for accommodation at a Hotel.
    • "Services" refers to all features and functionalities provided through the Platform, including hotel search, booking, and payment processing.

    3. Nature of the Service

    3.1 Marketplace Role

    CheckInn operates as an online marketplace platform that connects Guests with Hotels. We are not a hotel operator, travel agent, or tour operator. We do not own, manage, or control any of the Hotels listed on our Platform.

    When you make a Booking through CheckInn, you are entering into a direct contractual relationship with the Hotel for the provision of accommodation services. CheckInn is not a party to this contract and does not guarantee the performance of any Hotel.

    3.2 Our Responsibilities

    CheckInn is responsible for:

    • Providing a platform for Guests to discover and book Hotels
    • Facilitating the collection and transfer of payments between Guests and Hotels
    • Providing customer support for Platform-related issues
    • Assisting in the resolution of disputes between Guests and Hotels

    4. Eligibility

    To use the Platform and make Bookings, you must:

    • Be at least 18 years of age
    • Have the legal capacity to enter into binding contracts
    • Provide accurate and complete information during the booking process
    • Have a valid payment method accepted on the Platform

    By using the Platform, you represent and warrant that you meet all eligibility requirements.


    5. Account Registration

    5.1 Account Creation

    While you may browse the Platform without an account, certain features may require you to create an account. When creating an account, you agree to:

    • Provide accurate, current, and complete information
    • Maintain and promptly update your account information
    • Keep your login credentials confidential
    • Accept responsibility for all activities that occur under your account

    5.2 Account Security

    You are responsible for maintaining the security of your account. You must notify us immediately if you become aware of any unauthorized use of your account or any other security breach.


    6. Bookings

    6.1 Making a Booking

    When you make a Booking through the Platform, you agree to:

    • Review all details of the Hotel and room type before confirming
    • Provide accurate guest information
    • Comply with the Hotel's policies and house rules
    • Pay all applicable charges

    6.2 Booking Confirmation

    A Booking is confirmed only after:

    • You have completed all required steps in the booking process
    • Payment has been successfully processed
    • You have received a booking confirmation with a reference number

    6.3 Booking Modifications

    Requests to modify a Booking (such as changing dates or room type) are subject to availability and may incur additional charges. Contact us as soon as possible if you need to modify your Booking.


    7. Payments

    7.1 Payment Methods

    We accept payments through various methods, including:

    • Mobile Money (MTN Mobile Money, Telecel Cash, AirtelTigo Money)
    • Credit and debit cards (Visa, Mastercard)

    7.2 Payment Options

    Depending on the Hotel's policies, you may have the option to:

    • Pay in full at the time of booking
    • Pay a deposit (typically 30%) at the time of booking, with the balance due at the Hotel

    7.3 Payment Processing

    Payments are processed securely through Paystack, our payment service provider. By making a payment, you agree to Paystack's terms of service in addition to these Terms.

    7.4 Currency

    All prices on the Platform are displayed in Ghana Cedis (GHS) unless otherwise stated.


    8. Cancellations and Refunds

    8.1 Standard Cancellation Policy

    Unless otherwise stated in the Hotel's specific cancellation policy:

    • Free cancellation is available up to 24 hours before the scheduled check-in time
    • Cancellations made less than 24 hours before check-in will result in forfeiture of any deposit paid
    • For full prepayment bookings cancelled less than 24 hours before check-in, a refund of 70% of the total booking amount may be issued

    8.2 How to Cancel

    To cancel a Booking, you must submit a cancellation request through the Platform or by contacting our customer support. Cancellations are effective only upon confirmation from CheckInn.

    8.3 Refund Processing

    Refunds, where applicable, will be processed to the original payment method. Please allow 5-10 business days for the refund to reflect in your account. Payment processing fees incurred during the original transaction are non-refundable and will be deducted from any refund amount.

    8.4 No-Shows

    If you fail to check in without cancelling your Booking (a "no-show"), you will not be entitled to any refund, and the Hotel will retain the full booking amount.


    9. Hotel Policies

    Each Hotel on the Platform may have its own policies regarding:

    • Check-in and check-out times
    • Cancellation terms
    • House rules
    • Additional fees and charges

    It is your responsibility to review and comply with the Hotel's policies before making a Booking. These policies are displayed on the Hotel's listing page.


    10. Guest Conduct

    When staying at a Hotel booked through CheckInn, you agree to:

    • Comply with all applicable laws and regulations
    • Respect the Hotel's property and staff
    • Follow the Hotel's house rules
    • Be responsible for any damage caused by you or your guests
    • Not engage in any illegal, harmful, or disruptive activities

    11. Disputes and Resolution

    11.1 Issues with Your Stay

    If you experience any issues during your stay that do not match what was advertised on the Platform, you should:

    • First attempt to resolve the issue directly with the Hotel
    • If unresolved, contact CheckInn customer support with details of the issue and any supporting documentation

    11.2 Our Role in Disputes

    CheckInn will attempt to mediate disputes between Guests and Hotels in good faith. If the Hotel is found to be at fault, we will work with the Hotel to arrange an appropriate remedy, which may include a partial or full refund. In extenuating circumstances, CheckInn may issue a partial refund at its discretion.

    However, as a marketplace platform, CheckInn cannot guarantee any particular outcome and is not liable for the actions or omissions of Hotels.


    12. Prohibited Uses

    You agree not to use the Platform for any purpose that is unlawful or prohibited by these Terms. Prohibited uses include, but are not limited to:

    • Making fraudulent bookings or using stolen payment methods
    • Providing false or misleading information
    • Booking accommodations for illegal purposes
    • Attempting to circumvent the Platform to avoid paying applicable fees
    • Scraping, data mining, or using automated means to access the Platform
    • Interfering with or disrupting the Platform's operation
    • Impersonating any person or entity
    • Harassing, threatening, or intimidating Hotel staff or other users
    • Using the Platform to transmit malware, viruses, or other harmful code

    13. Intellectual Property

    All content on the Platform, including text, graphics, logos, images, and software, is the property of InnSync Technologies or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our express written permission.


    14. Limitation of Liability

    To the maximum extent permitted by applicable law:

    • CheckInn provides the Platform on an "as is" and "as available" basis without warranties of any kind
    • CheckInn is not liable for the quality, safety, suitability, or legality of any Hotel or accommodation
    • CheckInn is not liable for any indirect, incidental, special, consequential, or punitive damages
    • CheckInn's total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to CheckInn in the 12 months preceding the claim

    These limitations do not exclude or limit liability where it cannot be lawfully excluded or limited.


    15. Indemnification

    You agree to indemnify, defend, and hold harmless InnSync Technologies, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

    • Your use of the Platform
    • Your violation of these Terms
    • Your violation of any rights of any third party
    • Your conduct during any Hotel stay

    16. Privacy

    Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of your information as described in the Privacy Policy.


    17. Modifications to Terms

    We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the modified Terms.


    18. Termination

    We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.


    19. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Republic of Ghana.


    20. General Provisions

    20.1 Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and CheckInn regarding your use of the Platform.

    20.2 Severability

    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

    20.3 Waiver

    Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

    20.4 Assignment

    You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
